Legal Tutorials Page

AS always, my tutorials here are never a replacement for consulting a real Intellectual Property lawyer. Use these documents at your own risk.

Hi all! Well, thanks to my basically terrible experiences with art and art law, and the fact that I'm now working to help launch Conclave of Artists, a division of Amethyst Alliance, I've had to do all kinds of research into legal issues. As always, I want to share what I know about the law with you, to protect you from the horrors of Intellectual Property Law.

Unlike most of my tutorials, these are not yet Public Domain, because a lot of this material is also going to be used in the CoA, which I know would eventually like to hold copyright over the versions they'll be using. However, for now, these documents copyright 1999 me. And, when the CoA versions and my versions differ enough, I will then be able to put my documents into the public domain, like I like to do.

ARTISTS LEGAL PRIMER - The first tutorial, The Artists' Legal Primer, just helps you get to know what's legal to draw, and what isn't.

RIGHTS REQUEST FORM FOR COMMISSION CLIENTS -

The second document is a rights form, to help you take commissions from people out there in the world. It clarifies what rights you have over your art if you do a commission. Basically, you have all the rights over your art. There's a misconception among artists that if a person sends you a written description and you draw it, they somehow own the art you make. THIS IS NOT TRUE! A picture is never derivative of words. It can be derivative of other visual images, or of something that has the same look and feel as a trademarked property...but hey...you'll learn all about that in the Legal Primer.

As always, I'll write more as I find more time, and more things, to write about. :) Got Questions? Fire away! dee@dreslough.com
